IN CONSIDERATION of your payment of the account subscription fee, you, and any entity for which you are acting on behalf of, are acknowledging and agreeing to the following terms and conditions:
Allhay.com, LLC is providing the sole service of creating an online forum within which buyers and sellers of hay and other livestock feeds may communicate and transact with one another. Allhay.com, LLC assumes no liability or responsibility for any transactions you enter into with any other subscribers, users or members of Allhay.com, LLC. All transactions are at your own risk. Allhay.com, LLC reserves the right to terminate your Subscription for any reason with or without cause. Should your Subscription be terminated, your subscription and account shall be deactivated immediately. In purchasing a subscription to Allhay.com, LLC, you are indemnifying Allhay.com, LLC from and against any and all claims concerning the storage, loss or mishandling of your personal or entity data. This Account Subscription Agreement shall be interpreted under the laws of the State of Kansas. Further, in paying the account subscription fee you are consenting and submitting to the jurisdiction of the District Court of Finney County, Kansas to litigate or resolve any dispute you or your entity encounters with Allhay.com, LLC. In the event, and as often as, Allhay.com, LLC is forced to defend or enforce the terms of this Account Subscription Agreement, you shall be responsible for the payment of any and all costs of defense or enforcement, including, but not limited, to reasonable attorneys’ fees and court costs.
